DMCA Policy

Samenwerkende Omroep respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Samenwerkende Omroep will respond expeditiously to claims of copyright infringement committed using the Samenwerkende Omroep service and/or the Samenwerkende Omroep website (the "Site") if such claims are reported to Samenwerkende Omroep's Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice and counter-notice. We suggest that you consult with a legal professional before filing a notice or counter-notice.

Filing a DMCA Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Samenwerkende Omroep's Designated Copyright Agent.

Upon receipt of a valid Notice as described below, Samenwerkende Omroep will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

Please note that if you knowingly materially misrepresent that material or activity is infringing, you may be liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail about the copyrighted work you believe has been infringed (for example, the title, author, and registration number, if applicable).
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled: Provide the URL(s) and any other specific information reasonably sufficient to permit Samenwerkende Omroep to locate the material.
  3. Information reasonably sufficient to permit Samenwerkende Omroep to contact the complaining party: Include your name, address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. (Typing your full legal name will be accepted as an electronic signature.)

Filing a DMCA Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, you may send a Counter-Notification containing the following information to Samenwerkende Omroep's Designated Copyright Agent.

Please note that if you knowingly materially misrepresent that material or activity was removed or disabled by mistake or misidentification, you may be liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

  • Identification of the material that has been removed or to which access has been disabled: Provide the URL(s) where the material appeared before it was removed or disabled.
  • Your name, address, telephone number, and, if available, an email address.
  • A statement that you consent to the jurisdiction of the federal court in the district where your address is located (or if you are outside of the United States, in any judicial district in which Samenwerkende Omroep may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Your physical or electronic signature. (Typing your full legal name will be accepted as an electronic signature.)
